Terms and Conditions
Welcome to Curate-It the platform that will provide users with all they need to know for hosting their own film screening event. Through our step-by-step programme users will be able to learn the practices and processes of film curation, marketing, funding, budgeting, negotiation processes, evaluation and monitoring, risk management, and event planning and execution. The app is available to be used on mobile or desktop, with access on IOS and Android mobile devices.
1. General
1.1 Curate-It’s website, mobile applications (“apps”) and all related services are operated by Aya Films CiC (“Aya Films”, “Curate-It” or “we”).
1.2 By using any of the aforementioned services, the user (“user”, “participant”, “subscriber” or “you”) is assumed to have read and understood the Terms and Conditions detailed below. Please read these Terms and Conditions prior to purchase as they contain important information regarding users legal rights, remedies and obligations.
1.3 Aya Films reserves the right to change, amend or update these Terms and Conditions at any time. If we do so, users will be notified on our website and via email (if opted-in). Users can find the date of the latest revision of these Terms and Conditions at the bottom of the page.
2. CURATE-IT SERVICES
The services provided by Curate-It websites and apps include:
- Information and activities for learning the aforementioned topics.
- A selection of films to view.
- Messenger function to chat with other participants on the programme.
- Notebook to document activities and learning.
- Videos from experts in the UK film industry.
- Individual or team functions allow users to undertake the course individually or a part of a team.
- The option to show films online and generate revenue from the screenings.
3. REGISTRATION, SUBSCRIPTION, BILLING AND CANCELLATION
Registration for the Curate-It app can be undertaken through Apple’s iTunes or Google Play. You register by creating an account using your name, email address, and curatorial interests. You are responsible for ensuring your account details and password remain confidential by restricting access to your devices. Your account will be valid for 6 months from the date of purchase during which time you can undertake the programme.
3.1 Billing
By creating an account on Curate-It users authorise us to charge you to your chosen payment method. We will take 100% of the payment upfront for use of the programme, and then a monthly payment if users opt in to undertake the Subscription following the 6 month term (see clause 3.1b). Payment can be made by bank, PayPal or credit card.
a) Individuals: You can select the individual payment package through which only you, a single user, will receive a login to undertake the course.
b) Teams: The pricing of teams works incrementally based on the number of individuals in a team. The team owner will be responsible for payment of the whole fee upfront. An email with login instructions will be sent to each team member following purchase.
3.2 Subscription
Once users have completed the Curate-It course you can continue to show films on the Curate-It video-on-demand (VoD) platform (“Screen-it”) on a subscription basis (see section 10).
3.3 Cancellation
a) Curate-It: Users have a 14-day refundable cancellation period from the time of purchase for use of the Curate-It platform.
a) Screen-it: For subscription to Curate-It’s VoD platform Screen-it, users can cancel at any time, and will continue to have access to the VoD service until the end of the billing period. The subscription payment is non-refundable.
3.4 Age Restrictions
Registration to Curate-It is strictly limited to those who are aged 18 and over.
4. ACCOUNTS AND PASSWORDS
4.1 Account Details
Users have access and control over their Curate-It account. Users can access through use of their Username and Password. Account details should be kept private, and users should not disclose their Username, Password or any other account information to any third party.
4.2 Content
The Curate-It platform and any content viewed through the service are for your personal and non-commercial use only and may not be shared with individuals beyond your household.
4.3 Personal Information
You should be mindful of any communication requesting that you submit credit card or other account information. Providing your information in response to these types of communications can result in identity theft. Always access your sensitive account information by going directly to the Curate-It website and not through a hyperlink in an email or any other electronic communication, even if it looks official. See clause 6 for details on Curate-It’s use of data and privacy.
4.4 Account Termination
a) Curate-It reserves the right to place any account on hold anytime with or without notification to the user or subscriber in order to protect you, us and our partners from what it believes to be fraudulent activity.
b) Curate-It may terminate your access and use of its services immediately if it believes you to knowingly be in breach of its Terms and Conditions, and at such time you will have no further right to use Curate-It. You may also terminate your Curate-It account at any time by following the instructions available through our website. However, you will only receive a refund if terminated within 14-days of purchase (see clause 3.3).
5. CUSTOMER SUPPORT
If you require information assistance prior to purchasing Curate-It you can ask questions on the contact page on the Curate-It website.
6. PRIVACY
We collect personal information about the user through their login and profile. This information will be kept private and confidential in keeping with GDPR regulations, and will only be displayed to the public through our directory if the user opts in for this service.
7. COPYRIGHT
7.1 Proprietary Rights
All content contained with the Curate-It apps and website, including logos, activities, designs, videos, images, text and all other information, is the proprietary property of Curate-It and Aya Films. This content cannot be copied, distributed, framed, reproduced, republished, downloaded, scraped, displayed, posted, transmitted, or sold, in whole or in part, other than in cases specifically laid out in these Terms and Conditions (see clause 7.2). By registering for Curate-It, and therefore agreeing to these Terms and Conditions, users agree not to reproduce, modify, publish, license, offer for sale any information contained on the Curate-It platform.
7.2 Exceptions: User-Generated Content
Users will have sole ownership of any notes and activities they complete during the programme. These will be documented within the user notebook and exported as a PDF following the end of the period.
8. THIRD PARTY SITES
The Curate-It app, website and other services may contain links to third-party websites or services (including Curate-It partner sites) that are not owned or controlled by Curate-It or Aya Films. We do not endorse or assume any responsibility for any such third-party. By entering these third party sites, the user understands that Curate-It’s Terms and Conditions do not apply to the use of these sites or any content associated with them.
8.1 Watch-it
As part of the Watch-it section of the Curate-It course, we have entered into a partnership with VoD platform MUBI. This partnership will offer Curate-It users with an extended trial period to watch films on their platform. If Curate-It users choose to enter into subscriptions with these third parties they indemnify us from any liability herein and agree to follow the terms of service outlined by the respective platforms.

8.2 Screen-it
The films uploaded and screened via Curate-It’s VoD platform Screen-it (see clause 10 for more detail) are hosted on third party secure online video platform dacast.com, which is integrated into the Curate-It app and website as an API. If Curate-It users choose to screen a film on Screen-it they agree to the privacy and data rights management protocols outlined by dacast.com.

9. TERRITORIES
The Curate-It website, apps and other services are available globally. Availability of certain films featured in Curate-It’s Watch-it section - including those contained within the MUBI platform - may vary depending on the user’s region or geographical location.
10. SCREEN-IT
Curate It’s Screen-it platform allows users to show films online using our custom built VoD player. Films shown on Screen-it can be geo-blocked, include closed caption files, and have the necessary data rights management to avoid piracy (see clause of 8.2a for details of platform’s hosting platform, including security and piracy).
10.1 User Responsibility
If the user wishes to show films on the Screen-it platform they must obtain the necessary licensing permissions from the rights holder and pay any screening fees, and provide evidence of such to Curate-It admin. By registering with and using Curate-It’s Screen-it VoD platform you indemnify us against claims, liabilities, damages costs and expenses arising in relation to the film shown on the platform.
10.2 Ticketing, Paywall and Remuneration
Screen-it allows users to charge audiences for the film screenings and events via a paywall, with tickets charged on a sliding scale pricing system.
a) Rate: Aya Films shall pay remuneration to the user at a rate of 70% (minus Stripe fees) of ticket sales for each feature-length film or package of short films shown on the Screen-it platform. We use the payment system Stripe for this, and Stripe fees will be deducted before the final amount (0.25% +10p of each transaction)
b) Rendering of Accounts: Users shall receive payment for each event or screening by submitting a payment request through the app. Payments will be made within 30 days from the date of such. Curate-It will provide the user with detailed accounts of numbers and revenue generated from each screening. The transactions shall be recorded in British Pound Sterling.
10.3 Inappropriate Use
Users agree that they will not upload or select any content that is libelous, defamatory, abusive, threatening, harassing, hateful, offensive or otherwise violates any law or infringes upon the right of any third party. Curate-It reserves the right to restrict screenings that may be considered as such.
11. INDEMNIFICATION OF CURATE-IT
The user fully indemnifies and hold harmless Curate-It (and its affiliates, respective successors, assigns, distributors, officers, directors, employees and representatives) against and for any and all claims, liabilities, losses, damages, costs and expenses arising from or related to any breach by the indemnifying party of any of its undertakings, representations, and/or arising from or related to any and all third party claims which, if proven would be such breach. This includes but it not limited to solicitor fees, arising out of or relating to your access or use of the platform, any false representation made to us (as part of these Terms and Conditions or otherwise), your breach of any of these Terms and Conditions, or any claim that any translation we provide to you is inaccurate, inappropriate or defective in any way whatsoever.
12. GEO-BLOCKING
10.3 Geo- blocking Films and events shown on Screen-it, the public facing VoD platform are geo-blocked to certain geographical territories. It is the responsibility of the purchaser to ensure that the films or events are available within the geographical area in which they are situated
13. GOVERNING LAW
This Curate-It platform and all issues related thereto shall be governed by UK Law, any dispute arising shall therefore be adjudicated in the appropriate forum in this territory.
